Every person charged with a crime has the constitutional right to legal representation, even if they cannot afford an attorney. In Fallon, that responsibility falls to the Churchill County Office of the Public Defender and, when conflicts arise, the Alternate Public Defender's Office.
The Public Defender's Office provides legal representation to individuals who qualify for court-appointed counsel in criminal cases. The office helps fulfill the constitutional guarantee of legal representation and serves as a key part of the county's criminal justice system.
The Alternate Public Defender's Office serves a different but equally important role. The office represents defendants when the Public Defender's Office has a conflict of interest or is otherwise unable to provide representation. For example, conflicts can occur when multiple defendants are involved in the same case, requiring separate legal counsel.
Public Defender Jacob Sommer presented the department's budget request during Churchill County's budget review process, focusing primarily on staffing needs as the office expands to meet state requirements.
The proposed budget includes approximately $766,000 in salaries and wages to support four deputy public defender positions. A fifth attorney position is expected to be filled by the office's current legal intern after passing the bar exam.
Sommer also requested reclassifying a senior legal secretary position to a legal office services supervisor position, which he estimated would cost the county about $700 annually after state reimbursement. He requested adding a new legal secretary position with an estimated net county cost of $4,400 per year.
In addition, Sommer proposed creating a social worker and liaison position. He estimated the position would cost the county approximately $3,750 annually after reimbursement from the state. Sommer said the request could be deferred to a future budget cycle if necessary.
Sommer noted that operating and supply requests were lower than the previous year as the department continues refining its budget needs.
Alternate Public Defender Wright Noel said his office works alongside the county's indigent defense system to ensure legal services remain available while meeting state workload and compliance requirements.
Noel's proposed budget remained largely unchanged from the previous year. His primary request was the reclassification of legal secretary Tara Price-Gritzmacher to a senior legal secretary position. He estimated the change would cost approximately $2,700 annually, with the county's net cost reduced to about $300 after state reimbursement.
The proposed budget includes approximately $165,000 in salaries and wages to fund one deputy public defender position and the secretary position.
Noel said adding an additional attorney would improve reimbursement rates from the Nevada Department of Indigent Defense Services, reducing the county's annual operating cost from approximately $31,000 to about $17,000.
Together, the Public Defender's Office and Alternate Public Defender's Office help ensure that Churchill County residents who cannot afford legal counsel still receive representation as guaranteed under the U.S. Constitution.
