District Court News from January 16

The Tenth Judicial District Court convened on Tuesday, January 16, with Judge Thomas Stockard presiding. 

Tanya C. Clay pleaded guilty to the Category D Felony of Possession of a Schedule I or II Controlled Substance for the Purpose of Sale, a First Offense which carries a potential penalty of 1-4 years in Nevada State Prison and a fine of up to $5,000. According to the factual basis given for the charge, Clay possessed cannabis concentrate for the purpose of sale. A Pre-Sentencing Investigation was ordered, with sentencing set for April 9. 
Tyrrell Raphael Franklin, in custody, pleaded no contest to the Category D Felony of Arson in the Third Degree, which carries a potential penalty of 1-4 years in prison and a fine of up to $5,000. According to the state, Franklin set fire to a travel trailer/recreational vehicle. Judge Stockard provisionally placed Franklin into the Western Regional Specialty Court program and granted his release from custody after his first appearance in Specialty Court. A Pre-Sentence Investigation was ordered, with sentencing set for April 9. 

Matt Charles Lane appeared for sentencing on a probation violation, to which he admitted. This was Lane's fifth violation regarding restitution payments attached to a December 2020 case of Exploitation of an Elderly or Vulnerable Person for an Amount over $5,000, a Category B Felony, in which Lane stole close to $30,000 from his grandmother. At the time of sentencing, the victim requested the court to grant Lane probation, at which time Lane stated he would pay $1,000 restitution per month. Deputy District Attorney Priscilla Baker asked the court to revoke Lane’s probation and send him to prison, stating, “He has shown this court that he is not going to pay.” In nearly three years, he has paid just over $5,000. The court determined that graduated sanctions had been exhausted. Judge Stockard modified the original sentence from 96-240 months to 28-86 months in prison. Lane was remanded to the custody of the Churchill County Sheriff’s Office for imposition of sentence. 

Cortney Lynn Martin, in custody, appeared for sentencing on the Category B Felony of Battery with a Deadly Weapon Causing Substantial Bodily Harm to a Victim that Constitutes Domestic Violence. Last October, Martin pled guilty to the charge. According to the factual basis given, she stabbed her husband with a knife four times, causing prolonged physical pain. Judge Stockard sentenced Martin to 64-160 months in prison. Credit was given for 244 days for time served, and Martin was remanded to the custody of the sheriff for imposition of sentence. 

Selina Muncy appeared for sentencing on Non-payment of Child Support, a Gross Misdemeanor. Muncy was fined $250, with fees and assessments imposed. 

Brandon Lee Reynolds pleaded guilty to the Category D Felony of Fraudulent Use of a Credit Card or Debit Card, which carries a possible penalty of 1-4 years in prison and a fine of up to $5,000. A Pre-Sentence Investigation was ordered, and sentencing was set for April 9. 

Herbert Crazyhorse Williams pleaded guilty to two Gross Misdemeanor charges: 1) Battery of an Officer, a Provider of Healthcare, a School Employee, a Taxicab Driver, a Transit Operator, or a Sports Official, and 2) Conspiracy to Commit Burglary. Each charge carries a potential penalty of up to 365 days in jail and a fine of up to $2,000. The battery charge was said to have occurred during an interaction between Williams and a law enforcement officer in the Wal-Mart parking lot when Williams pushed or grabbed the arm of the officer. On the conspiracy charge, Williams allegedly went to Wal-Mart with another individual and conspired with them to take items from the store. Judge Stockard placed Williams on probation for 12 months on a suspended sentence of 364 days in jail on the battery charge and 120 days on the conspiracy charge, for a total of 484 days. Stockard fined Williams $500 on the battery charge, to be paid at $100 monthly.

Deanna Marie Burell was not present for her arraignment. A $25,000 cash-only bench warrant was issued.
Brian Keith Alford - Arraignment continued to January 30.
Jessop Reece Morrison's - Sentencing continued to March 5.
Tasia Marie Ratti's - Status Hearing continued to January 24. 
Brandon Heleodoro Rodriguez-Sigala - Status Hearing was continued to February 6.
Brian James Wilberg's - Arraignment continued to February 23.
