District Court News - December 5

The Tenth Judicial District Court convened Tuesday, December 5, Judge Thomas Stockard presiding.

Christopher Allen Montooth pleaded not guilty to Driving Under the Influence of an Intoxicating Liquor or Controlled or Prohibited Substance with a Prior Felony Conviction for Driving Under the Influence, which carries a mandatory prison sentence of 2-15 years and a fine of $2,000-$5,000. Trial was set for June 26-28, 2024. A criminal mediation/settlement conference was set for March 29, 2024.

Daniel Angel Escalante pleaded no contest to the charge of Attempt to Commit Battery causing Substantial Bodily Harm. This charge carries a possible punishment of 364 in Churchill County Jail and a fine of up to $2,000 if sentenced as a gross misdemeanor or 1-4 years in Nevada State Prison and a fine of not more than $5,000 if sentenced as a felony. A Pre-Sentence Investigation was ordered, and sentencing was set for March 5, 2024.

Tasia Marie Ratti appeared via Zoom from Westcare Transitional Housing for a Status Hearing. A trial for her federal charges is set for May of 2024. Her next Status Hearing in Tenth District was set for January 16, 2024.

Timothy Eugene Tiboni pleaded guilty to the Gross Misdemeanor charge of Violating a Domestic Protection Order. Fees and assessments were imposed. Tiboni received a sentence of 364 days in Churchill County Jail, suspended, with 12 months of probation. The defendant was placed into the Western Regional Drug Court program and ordered to obtain a Substance Abuse Evaluation and to follow the recommendations thereof along with standard conditions of probation. Tiboni was also ordered to have no contact with the person on the protective order until he gets the protection order resolved.

Hailey Leann Southard received a sentence of 364 days in Churchill County Jail on a charge of Attempt to Commit, Manufacture, Import, Possession, or Use of a Dangerous Weapon or Carrying a Concealed Weapon Without a Permit. The sentence was suspended, and Southard was placed on probation for 12 months. In addition to standard conditions of probation, Southard was ordered to obtain a Substance Abuse Evaluation and to follow the recommendations therein. Fees and assessments were imposed.

Ronnie Anton Stark pleaded guilty to the charge of Attempt to Commit an Open or Gross Lewdness, a second or subsequent event. This charge carries a potential penalty of 364 days in Churchill County Jail and a fine of not more than $2,000 if sentenced as a gross misdemeanor or 1-4 years in a Nevada State Prison and a fine of up to $5,000 if sentenced as a felony. He will also be required to register as a sex offender. To be considered for probation, Stark was required to obtain a Psychosexual Evaluation, which determined he is not at a high level to re-offend. A Pre-Sentence Investigative Report was ordered, and sentencing was set for February 27, 2024.

Brandon Tyler Gonzalez appeared for sentencing on the Category B Felony of Grand Larceny of a Firearm. Fees and assessments were imposed, along with a fine of $1,600 and $180 restitution. He received a sentence of 28-84 months, suspended, with 36 months probation. In addition to standard conditions of probation, the defendant was ordered to obtain a substance abuse evaluation and to follow the recommendations thereof; to maintain active employment and to have no contact with the victim or with the purchaser of the firearm. The judge added the condition that the defendant spend the next 15 weekends in Churchill County Jail.

Robin Daresa Lucille Brady, in custody, admitted to a non-technical probation violation regarding failure to report, failure to obtain a substance abuse evaluation, and absconding. Her probation was reinstated with the additional condition that she enter and complete the Western Regional Drug Court program.

Coleen Rose Camilli appeared for sentencing on the Category B Felony of Abuse, Neglect, or Endangerment of a Child. The court received a Psychological Risk Assessment from Dr. Samantha Swanson, which showed Camilli at a medium to high risk of reoffending. Following arguments by the state and the defense, Camilli received a suspended sentence of 28-72 months in Nevada State Prison and 36 months of probation. In addition to standard conditions of probation, the defendant was ordered to serve 220 days in Churchill County Jail on her days off work. She was also ordered to obtain a Mental Health Evaluation within the next 6 months and to follow the recommendations thereof; to participate in and complete couples counseling; to complete an anger management course; and to have no contact with the victim. Fees and assessments were imposed.

Continuances:
Alisha Nicole Dodge's hearing regarding being removed from drug court was continued to December 12.
Landon Dakota Mason's sentencing was continued to January 9, 2024.
Cody Lamar Etchinek’s sentencing was continued to January 9, 2024.
