District Court News - November 14

The Tenth Judicial District Court convened Tuesday, November 14, Judge Thomas Stockard presiding.  

Autumn Nicole Castleberry pleaded not guilty to a charge of Possession of a Controlled Substance, a first or second offense, punishable by 1-4 years in prison and a fine of up to $5,000. On October 31, the judge had ordered Castleberry to go to Court Services and be tested by 4:30 p.m. that day. However, Castleberry failed to do so.  The judge told Castleberry, “When the court orders you to do something, that takes priority over everything.” Due to her failure to comply with his order, Stockard told her, “You will remain here [in the courtroom] today until we are done. Then, you will meet with Court Services, and you will check in daily, submit to random drug testing, and check in weekly with your attorney. 

Jose Luis Ibarra, in custody, pleaded not guilty to a charge of Driving under the Influence of an Intoxicating Liquor or a Controlled or Prohibited Substance Causing Death or Substantial Bodily Harm, which carries a potential penalty of 2-20 years in Nevada State Prison and a fine of $2,000-5,000. Ibarra will face a mandatory prison sentence if the defendant is found guilty. Following arguments by the state and the defense regarding custodial status, the judge reinstated Ibarra's own recognizance release with modified conditions. Violating these conditions will result in Ibarra’s immediate return to custody. A Criminal Settlement Conference was tentatively set for January 8, 2024, in which a senior judge from another district will hear the case. If no satisfactory resolution is reached, a jury trial will be set. A status hearing was set for January 16, 2024.

Beau Anthony Poutous pleaded guilty to a charge of Buying, Possessing, Receiving, or Holding Stolen Property of a value of $5,000-$25,000, which carries a potential penalty of 1-5 years in prison and a fine of up to $10,000.  A Pre-Sentence Investigative Report was ordered, and sentencing was set for February 6, 2024. 
Paul Anthony Rice, in custody, appeared on several Technical Probation Violations. The judge temporarily revoked Rice’s probation for 20 days and granted credit for 20 days of time served. Rice was then reinstated on probation with all the previous and standard conditions. Rice received 96 months of probation on suspended multiple prison sentences totaling 80-210 months last April. The judge told Rice he was to obtain a substance abuse evaluation within the next 30 days and to follow the recommendations therein. P&P was told to violate Rice’s probation again if he did not comply. 

Dylan James Irwin Schostag appeared for sentencing on the Gross Misdemeanor charge of Injury to another person's property valued between $250 and $5,000, to which he pled guilty in April. At that time, the defense challenged the restitution amount of $14,318.15.  After listening to testimony, along with arguments and court-ordered briefs from both attorneys, restitution of $2,870.20 was ordered paid at a rate of $250 a month. Schostag received a sentence of 364 days in Churchill County Jail, suspended, and 12 months probation. Fees and assessments were imposed. Judge Stockard further ordered Schostag to complete an anger management class and to have no contact with the victim or the victim's property. 

Matthew Logan Spry, in custody, pleaded not guilty to multiple Category A Felonies that carry mandatory prison terms of 10 years to life in prison, including, but not limited to, Lewdness with a Child Under the Age of 14 and three counts of Sexual Assault on a Child Under the Age of 14.  A Criminal Settlement Conference was set for May, with a trial slated for July 22-26, 2024, should the settlement not result in a resolution. Jose Carlos Trujillo, in custody, pleaded guilty to low-level Possession of a Controlled Substance punishable by 1-5 years in prison and a fine of up to $10,000, and Fraudulent Use of a Credit Card or a Debit Card punishable by 1-4 years and a fine of up to $5,000. A Pre-Sentence Investigative Report was ordered, and sentencing was set for February 6, 2024.    

  • Continuances  
    Elijah Blue Aughe appeared for a Status Hearing. A jury trial was set for December 6-8. However, that date has been vacated due to scheduling conflicts with Aughe’s attorney. A new trial date will be set. 
  • Yanira Lopez-Cortez, in custody, appeared for a Judicial Review. The case was remanded back to Justice Court.
  • Matthew Joseph Grant, in custody, the case was continued to December 19 at the request of his attorney.
