District Court News - November 7 Hearings

The Tenth Judicial District Court convened Tuesday, November 7, 2023, Judge Thomas Stockard presiding. 

Kristin Kay Scott, in custody, admitted to a Non-Technical Probation Violation involving absconding. Scott was reinstated on probation for 18 months. Along with standard conditions of probation, Scott was ordered to obtain a substance abuse evaluation and to follow the recommendations thereof, as well as attend all her court dates in Elko and fulfill her obligations there. Fees and assessments were imposed.

Star Joi Penola, in custody, pleaded guilty to the Gross Misdemeanor charge of Conspiracy to Unlawfully Obtain and Use the Personal Identifying Information of Another to avoid or delay prosecution, which carries a potential penalty of up to 364 days in Churchill County Jail and a fine of up to $2,000. Judge Stockard sentenced Penola to 13 months of probation, suspending 210 days in Churchill County Jail. She received credit for 38 days of time-served and was also ordered to obtain a substance abuse evaluation within 30 days. Further, Stockard ordered her to clean up and clear any failure to appear warrants and attend all future court dates. Fees and assessments were imposed. Penola will remain in custody until she can be transported to Humboldt County, were she currently has an outstanding warrant. 

Lanette Dawn Anderson, in custody, pleaded guilty to the Category E Felony of Possession of a Controlled Substance (methamphetamine), a first or second offense, which carries a potential penalty of 1-4 years in a Nevada State Prison and a fine of up to $5,000. Following arguments by the state and the defense, Judge Stockard modified the conditions of Anderson's release, provisionally placing her into the Western Regional Drug Court Program. A Pre-Sentence Investigative Report was ordered, and sentencing was set for January 30, 2024. 

Paul Martin Musgrave, in custody, pleaded guilty to the Category B Felony of high-level Possession of a Controlled Substance, which carries a potential penalty of 2-15 years in prison and a fine of up to $50,000. Musgrave was found in possession of more than 42 grams of methamphetamine. A Pre-Sentence Investigative Report was ordered, and sentencing was set for February 13, 2024.

Karen Edris Fenton appeared for sentencing. Fenton was originally scheduled to be sentenced on October 24, but the matter was continued upon the request of both the defense and the state. The Churchill County District Attorney’s Office filed an amended complaint in the case against her, requiring Judge Stockard to re-arraign Fenton on the amended information. Upon arraignment, she pleaded guilty to the Category B Felony of mid-level Possession of a Controlled Substance, which carries a potential penalty of 1-10 years in prison and a fine of up to $50,000. Fenton was sentenced to 14-72 months in prison and received time-served credit of 18 days. The defendant was remanded to the custody of the Sheriff for imposition of the sentence. Fees and assessments were imposed.

Ernest Wayne Fields, in custody, pleaded guilty to a Wobbler, which means the charge can be sentenced as either a Gross Misdemeanor or as a Category E Felony. Fields is charged with Attempt to Commit Grand Larceny of Personal Goods or Property in the amount of $1,200 - $5,000. If sentenced as a Gross Misdemeanor, the potential penalty is 364 days in Churchill County Jail and a fine of up to $2,000; if sentenced as an E Felony, the possible penalty is 1-4 years in Nevada State Prison and a fine of up to $5,000. 
Following a discussion between the defense and the state, Judge Stockard ordered Fields released directly to New Frontier Treatment Center once a bed date can be secured. Sentencing was set for January 30, 2024, to allow time for victim notification.

  • Sonnie Angelo Anzaldua's arraignment was continued to November 28. 
  • Stacy Lynn Arias’s arraignment continued to November 28.

The Melon Man was a perfect specimen for how to devote. His passing meant a life book of feeling/knowing what gives other humans their paths to Love and Knowledge.
