At one point, Caban drove through Fallon and reached speeds of 129 mph. He was initially charged with multiple felonies, which included: ex-felon in possession of a firearm, possession of a stolen vehicle, and eluding arrest. As well as several misdemeanors, which included: reckless driving, passing on the right, driving left of center, duty to stop at the scene of a crash involving property damage, driving with a revoked license, and possession of paraphernalia. Sommer noted that Hoyland did not create the video but did send it. Judge Stockard stated that the child in the video was described as approximately 6-8 years old. According to Stockard, the offense is probation eligible provided Hoyland submits to a psycho-sexual evaluation and is not deemed at high risk to re-offend.
