Scott Alexander Brown (in custody) failed to appear in court last week, for which a bench warrant was issued. Brown was subsequently arrested on the warrant and returned to custody. When tested for drugs on September 10, he tested positive for THC, methamphetamine, alcohol, amphetamine, and MDMA. In preparation for his arraignment, he was retested and returned positive results for methamphetamine, THC, and amphetamine. As the tests showed the presence of these drugs in his system, the case was postponed for one week as he cannot enter a plea while under the influence of drugs or alcohol. Bail was set at $100,000 cash only. , If he is able to post bail, he will be under the supervision of Court Services. Brown’s arraignment was set for September 21.
Guadalupe George Gonzalez (in custody) pled guilty to Attempt to Commit Unlawful Obtaining and Using of Personal Identifying Information of Another to Avoid or Delay Prosecution. In most cases, it is considered Category C Felony and can carry up to 5 years in prison. Churchill County Public Defender (CCPD) Wright Noel, counsel for Gonzalez, stated that his client used another person’s name or driver’s license number to avoid or delay prosecution on other charges in Fresno, CA. A presentencing investigation was ordered, and sentencing was set for December 7, 2021.
Loren Heath Martin (in custody) pled guilty to (1) Battery that Constitutes Domestic Violence, a Third or Subsequent Offense, a Category B Felony punishable by 1-6 years in prison, (2) Battery on an Officer, misdemeanor punishable by up to 364 days in jail. Charles Woodman Esq., counsel for Martin, stated that his client has two prior convictions and his client did push or shove his partner, which constitutes domestic violence. Further, after being placed under arrest, Martin did punch Sargent Shue. Sentencing was scheduled for December 7.
Stephanie Marie Kilgore (in custody) was sentenced on a charge of Attempt to Commit Burglary, a Category C Felony punishable by 1-10 years in prison. She received a suspended sentence of 14-40 months in prison and placed on probation. Kilgore was also ordered to pay $80 restitution to the victim, $1,725 in extradition fees from California to Nevada, must remain in Nevada until an interstate compact agreement from California is received.
Celestina Renee Ortiz appeared for sentencing on two counts. ADA Chelsea Sanford reminded the court of Ortiz’s statement in June when she asked for help in obtaining substance abuse treatment for which she promised to apply herself. According to Sanford, her request was granted and 25 days later Ortiz was kicked out of her treatment program and was rearrested. Sandford stated, “Actions speak louder than any words and every resource has been squandered." Sanford requested that the Court remove Ortiz from the Drug Diversion Program and that she be sent to prison. CCPD Jacob Sommer, defense counsel for Ortiz, asked if the court would consider probation and admittance into Western Regional Drug Court.
The Court found that Ortiz had violated the terms of probation from 2019, on a suspended sentence of 19-48 months in prison for Unlawful Use or Being Under the Influence of a Controlled Substance, which is a Class E Felony that carries a term of 1-4 years in prison. New probation was sentenced for that charge. Ortiz also received probation and suspended sentence of 19-48 months on the new charge of Possession of Controlled Substance, Class E Felony that carries a term of 1-4 years in prison. The terms are to run consecutively and Ortiz must enter and complete Western Regional Drug Court.
Robert Benjamin Hill was not present for his scheduled arraignment. CCPD Wright Noel, counsel for Hill, stated that he has no explanation for his client’s absence. Hill was released under the supervision of Court Services, however, he has not maintained contact. A $25,000 cash-only bench warrant was ordered.
Lillian Frances Smith was arraigned and pled guilty to (1) Driving Under the Influence, a Third or Subsequent Offense, a Category B Felony punishable by 1-6 years in prison, (2) Battery on an Officer, a Gross Misdemeanor punishable by up to 364 days in jail. CCPD Jacob Sommer, counsel for Smith, stated his client was in control of a motor vehicle while under the influence with a blood alcohol above the state limits at .316. Sommer intends to get Smith into DUI Diversion as she has been on court services and understands that provisional admittance to DUI Diversion pending sentencing.
Aaron Benjamin Rives appeared for sentencing for Conspiracy to Commit Nonpayment of Child Support, a Gross Misdemeanor punishable by up to 364 days in jail. Rives received a suspended sentence with conditions and is to continue making his monthly payments.
Stephanie Torrez Herrera appeared for sentencing on charges of (1) Possession of Stolen Property, a Category C Felony (2) Offer, Attempt, or Commission of Unauthorized Act Relating to the Compounding or Manufacture of Certain Controlled Substances, a Category C Felony, (3) Failure to Appear After Admission or Release After Bail, a Category D Felony. After consideration of Herrera’s criminal history and other factors, Judge Stockard decided that Herrera was not a candidate for probation and remanded her to the custody of the sheriff. She was sentenced to 19-48 months in prison on the first and third counts and12-36 months in prison on with the terms to run consecutively.
