Wes Lattin Pleads Guilty

Wes Lattin accepted a plea offer made by Deputy District Attorney Chelsea Sanford yesterday in the matter of State v. Lattin, before Judge Tom Stockard in the 10th Judicial District Court. Represented by defense attorney Charles Woodman, Lattin pled guilty to one count of sexual assault of a minor under the age of 16, and one count of failure to appear. Both crimes are felonies.

Lattin was originally charged in 2003 for the sexual assault of a child under the age of 16, as well as three counts of open and gross lewdness. When that trial was under way, in August of 2005, Lattin disappeared, going on the lam for 15 years.

Penalties for the sexual assault charge carry a mandatory prison sentence, with two different possibilities to be decided at the time of sentencing: life with the possibility of parole after 20 years, or 20 years with the possibility of parole after five years. Additionally, the penalty requires a sexual offender registration and lifetime supervision. In the matter of the failure to appear the penalty is one to four years in prison and a fine of $5,000.  

Sentencing is scheduled for July 21, 2020 at 11:00 a.m.

Because Lattin is not eligible for probation, a psychosexual evaluation is not necessary, however, the court can order one if it is felt to be needed for sentencing. The court did order a Pre-Sentencing Investigation which is an investigation done by the Division of Parole & Probation which includes criminal history of the defendant, a summary of the case, and any relevant information they believe the court should have during sentencing. The report is provided to the court and both counsel and is standard for most felonies, aiding in sentencing decisions.

Lattin was arrested February 21, 2020 after the Churchill County Sheriff investigated a report that Lattin was living in an underground bunker on the property of his sister, Becky Humphrey, four miles north of Fallon on Tarzyn Road.

According to Sheriff Richard Hickox, his office is still investigating the matter of the possibility of Humphrey harboring a fugitive as an open case.
