City Plans to Enforce Business Closures
Staff report --  The City of Fallon issued a statement today saying they intend to enforce a goal of “full voluntary compliance with Governor Sisolak’s Declaration” of Emergency last week. The statement issued by the Legal and Administrative Director at the City, Robert Erquiaga, says “the City will consider enforcement measures as appropriate which might include, suspension or revocation of the business license, and potential criminal prosecution for violation of NRS 202.595 and/or NRS 202.450.” According to the statement if the City receives a report of a business, or otherwise becomes aware of a business that is not in compliance with the Governor’s Declaration of Emergency Directive 003, and the Emergency Regulations of the Department of Public Safety, the City will refer to the “nature of Business” the business identified on its City of Fallon business license application. The business establishment must be conducting the business identified within the parameters of the nature listed. “If necessary, enforcement will follow a 3-step process of education, warning, and then enforcement. Should a business refuse to comply after discussion and a written warning, the City will consider enforcement measures as appropriate.” The statement also directs business owners to the U.S. Department of Homeland Security Cyber & Infrastructure Security Agency Essential Critical Infrastructure Workforce memorandum dated March 19, 2020, offering further guidance on the business closure requirements set by the Governor.
