The Tenth Judicial District Court convened Tuesday, February 21, Judge Thomas Stockard presiding
Lawrence Alvin Stone failed to appear for arraignment. A Bench Warrant was issued.
Amado Leonel Olvera-Perez appeared for a technical violation of probation. Olvera-Perez has failed to make any payments on his restitution since it was ordered in September 2022. The judge stated Olvera-Perez’s performance has been completely unacceptable. He temporarily revoked the defendant’s probation and sentenced him to 30 days in Churchill County Jail. Olvera-Perez was remanded to the custody of the Churchill County Sheriff for imposition of the sentence.
Matthew Logan Spry, in custody, appeared for arraignment on 5 Category A Felony charges. 1) Lewdness with a Minor Under 14 Years of Age, 2,3,4) Sexual Assault with a Minor Under 14 Years of Age, 5) Incest. Public Defender Jacob Sommer said he was recently appointed to the case and asked for a 6-week continuance. The judge granted a 6-week continuance to April 4 for the arraignment and a 1-week continuance to February 28 for addressing custody status.
Jose Natividad Rodriguez, in custody, appeared for sentencing on a Category E Felony charge of Assault with a Deadly Weapon. Public Defender Wright Noel told the court the defendant had not received a copy of the Pre-Sentence Investigative Report. Wright asked for a continuance to allow Rodriguez time to read the PS and to discuss it with him. The judge granted a continuance to March 7.I
Angela Lynn Sanchez, in custody, appeared for sentencing on a Category E Felony of Possession of a Controlled Substance 1st or 2nd offense. She received a suspended sentence of 19-48 months in Churchill County Jail and was placed on probation for 18 months with standard conditions applied. Fees and assessments were imposed. Sanchez was ordered to be released from custody.
Joe Henry Schilder, in custody, appeared on a non-technical probation violation regarding the intoxicants prohibition that involved a DUI. Schilder admitted to the violation. As Schilder’s term of probation is set to expire March 8, the judge ordered him dishonorably discharged from probation.
Myron Dean Pahe, in custody, appeared for a non-technical probation violation. Pahe had not received a copy of the violation report and therefore, a continuance was granted to March 7.
Christian S. Moreno-Ramos, in custody, appeared for a non-technical probation violation. As Moreno-Ramos had not had time to read the violation report the case was continued to March 7.
Robert Mark Havens pleaded guilty to a Category D Felony charge of Residential Burglary with Possession of a Firearm or a Deadly Weapon. ADA Priscilla Baker said the state is remaining silent per negotiations. PD Sommer told the court that Havens is living in Oregon where he is gainfully employed, he is clean, sober, and has good family support. Havens paid $1,000 toward restitution. Havens received a sentence of 36-96 months in Nevada State Prison, suspended, and was placed on probation for 36 months with standard conditions.
George Allen Smith, in custody at Elko Detention Center, appeared via Zoom for a probation violation. PD Sommer told the court he has not been able to talk with the defendant to discuss the case. The case was continued to March 7.
