The jury returned a verdict in the sexual assault case of James David McClain at 4:40, Friday afternoon November 19, in the Tenth Judicial District Court. McClain was facing 12 felony charges, including 11 counts of sexual assault of a child. The jury found McClain guilty on all counts, which included:
Four counts of sexual assault on a child under age 16 causing substantial bodily harm, a Category A Felony that carries a penalty of life in prison without the possibility of parole if the victim sustained substantial bodily harm.
Six counts of sexual assault on a child under age 14, a Category A Felony carries a penalty of life in prison without the possibility of parole if the victim sustained substantial bodily harm or the defendant had a prior conviction of sexual assault or a sexual offense against a child. Otherwise, the judge will impose life in prison with the possibility of parole after 35 years.
One count of sexual assault on a child under age 16, a Category A Felony that carries a penalty of life in prison without the possibility of parole if either the victim sustained substantial bodily harm, or the defendant had a prior conviction of sexual assault or a sexual offense against a child. Otherwise, the judge will impose life in prison with the possibility of parole after twenty-five (25) years.
One count of abuse, neglect, or endangerment of a child, a Category B Felony that carries a penalty of 2 – 20 years in the Nevada State Prison.
The court has not set a sentencing date. Judge Stockard thanked the jury for their time and service.
